E-Verify Reopens | Key Points for Employers and Employees

According to official announcements and reports, the E-Verify system is back online and operational as of October 9, 2025, after being suspended due to a federal government shutdown that began on October 1, 2025.

Here are the key points for employers and employees:

For Employers:

  • Deadline to Create Cases:

    • You must create an E-Verify case by Tuesday, October 14, 2025, for all employees hired while the system was down (from October 1 to October 7, 2025).
  • Reason for Delay:

    • When creating these cases, use the employee’s original hire date from their Form I-9. The system will prompt you to provide a reason for the delay; select “Other” from the dropdown menu and specify “E-Verify not available.”
  • Form I-9 Obligations:

    • The government shutdown did not change the requirement to complete Form I-9 within three business days of an employee’s start date. This obligation remains in effect.
  • Federal Contractors:

    • Any calendar days when E-Verify was unavailable will not count toward your federal contractor compliance deadlines.

For Employees:

  • Extended Time for Mismatches:

    • If you received a Tentative Nonconfirmation (mismatch) and were unable to resolve it during the E-Verify outage, you have been granted additional time.
  • New Deadline:

    • You can get your new referral date by either having your employer print a new “Referral Date Confirmation” notice, asking them to write the new date on your existing notice, or by adding six federal business days to the date on your original notice.

Due to the backlog of cases, E-Verify customer support is expected to experience longer-than-normal wait times.
